it was demonstrated by the prosecution that she formed a special bond with him and was in control of his life at that time, in that moment. that was part of their argument to the judge.

the law doesn't specify what you think it does, and the prosecutor went over that with the judge. the judges opinion will take that into account when he writes his opinion on the decision.

i dont see it getting tossed. I went into it like you, "ya just words" but the fact is the law is not very specific in this case. You might say "WELP MORE GROUNDS TO APPEAL THEN" and thats the beauty of law my friend. 2-way street depending on which Nose you get to oversee the proceeding.
