Recently started playing P1999, wasn't satisfied with ahungry, had a bit of free time. Here you go: http://ecmarket.webewizard.com

It's currently hosted on my personal computer, and auctions are tracked live from my character Weebee. The service may go down frequently until I can get something like an Intel NUC to put it on.

Enjoy, let me know what you think and if you run into any issues.

That's pretty sweet, I like it a lot! I especially like it showing both WTS and WTB lists seperately

good start, much cleaner and clear interface, still some bugs

picking the tribunal returns no items, even from wiki

also would be nice to atleast have an option for a recent raw feed of auction

Thanks for the input!

Ya, there are quite a few items still missing. The database is from the wiki's Item category so things like Spells, which technically have an item associated with them, don't show up in the wiki's item category.

The live auction chat is really what I was trying to avoid by making this, so you probably won't see it on the site any time soon. Instead I'll just keep refining the chat parser to catch more and more WTB/WTS postings.

There's apparently some functionality issues still. If you search "Mithril Greaves" (http://goo.gl/cJJ7Rd), you will find that it links to Imbued Koada`Dal Mithril Greaves for every single one.

It actually seems serious:
http://www.trademarks411.com/marks/75683664-auction-tracker

That being said, I'm no lawyer but I'm not sure the trademark applies here. Take Coke: Coke has trademarked "red", but that trademark only applies to people who want to make an all-red soda can. Coke can't (for instance) go after Wizards of the Coast for printing red Magic cards.

Since this trademark is for:

Computer software for use in the management of fund raising events or tracking guests, volunteers, donors and sponsors, assigning goods numbers and seating assignments, exporting to other programs and generating the necessary reportsand the site isn't even really about auctions (it just reports thing people said in a game) I doubt it would count. But again, I'm no lawyer. Certainly the safer option would be to rename it to "EC Transaction Tracker" or something.

Considering he's the self proclaimed CEO who is strolling a 17 year old elf simulator forum for 2 matching words unrelated to his product, I doubt anyone is getting paid much, including him.

while the name of the company is Legit and the number. You used the wrong Principal in the beginning. Also are you saying that you in fact made this auction tracker and that someone else is taking credit? I never knew that a ceo of a company would go out of his way to make something that uses Everquest logs to make an auction tracker.

Patents, trademarks and copyright law are far more about who can can afford to defend themselves and pay legal fees than they are about validity of a case.

Regardless of validity of claim you will lose if you can't afford to win. Nobody cares about the merits of claims anymore. If you have an attorney and are willing to pay them then they will do their lame lawyer thing, right or wrong.

I have witnessed companies pay money to avoid the legal process because paying is cheaper than lawyers even though if they defended themselves they would win.

So freaking lame our whole legal system.

I Just had a conversation with Jack W. This is how it went:

Your Question: Is this your company? http://www.project1999.com/forums/showthread.php?t=166038
Please wait and one of our operators will be with you shortly.
You are now chatting with Janessa B. (Application Support) - Application Support

Jack W. has joined the conversation.
18:59Jack W.:
My name is Jack Wilson and I am the owner of Northwest Software and the Primary Register Trademark "Auction Tracker"
19:00Donnie:
i doubt this is the same program that you own sir
19:00Jack W.:
Yep!
Janessa B. has left the conversation.
19:00Jack W.:
It sure is
19:00Donnie:
you might own the program but not the word combonation
19:00Donnie:
how?
19:01Jack W.:
http://tmsearch.uspto.gov/bin/showfield?f=doc&state=4802:yatonl.2.1
19:01Donnie:
everything about it screams it is for an emulated server for everquest
19:01Jack W.:
Oh yes I do. See link
19:01Jack W.:
Nope, your site was brought to my attention by 4 of our end-users earlier today. That is how I became aware of the mis-use of our federal trademark.
19:01Donnie:
it wont let me see it it says session timed out
19:02Donnie:
its not my site btw
19:02Donnie:
im just investigating
19:02Jack W.:
See that.
19:02Jack W.:
Go To www.uspto.gov
19:03Jack W.:
At the top click Search For Trademarks
19:03Jack W.:
Under Basic Word Search, enter Auction Tracker
19:03Jack W.:
It will bring up the Trademark I have owned since September of 2000.
19:04Jack W.:
14 years.
19:04Donnie:
i saw that befor
19:04Donnie:
but how do you no it is the same software you in fact own
19:04Jack W.:
I am the one who personally put that post up on that forum. That was not a bot.
19:04Donnie:
did you break into the server it is on?
19:05Jack W.:
Its not about the software, its about the mark. You have use a Federal Trademark to define something that it is not. That is a federal offense.
19:05Donnie:
so if it was called something else since you in fact own the combo of word Auction Tracker it would be fine
19:05Jack W.:
Given that my user base found it and reported it shows confusion.
19:07Jack W.:
Yes, if you called it something other than Auction Tracker that resolves the issue. I would suggest just using the word Tracker like another on your forum posted.
19:08Donnie:
ill put in a suggestion to call it something else then but i cant promise anything since i dont own the site. Some of the people there can be hard headed
19:08Jack W.:
So you are aware, I do not actively go out and search for violations everyday. But when my users bring it to my attention, I do have to find out what is happening and why.
19:09Jack W.:
Please know that my intent is to not be lawsuit happy but protecting a Trademark is very important.
19:09Donnie:
Also it isnt Project1999.com that owns the site http://ecmarket.webewizard.com.
19:09Donnie:
hey just run a forum
19:09Donnie:
they *
19:10Jack W.:
I know that the owner of the software you are using would get highly upset if someone used his title.
19:10Jack W.:
for same or other means.
19:10Donnie:
Is it ok for me to post this conversation so these people can see this?
19:11Donnie:
Actually Sony just doesnt care to be honest lol
19:11Jack W.:
If you like thats fine but this really is for the own of the software. A person who I could not track down.
19:11Donnie:
But i see where you are coming from
19:12Donnie:
Thank you for answering this personally sir
19:13Jack W.:
no problem! more than happy to.
19:13Jack W.:
Thank you for understanding.
19:13Donnie:
Have a great day and i hope that this doesnt happen anymore

Well, if he, or any of his users bothered to click the link they would find that the product is not called Auction Tracker, nor is it called EC Market Auction Tracker. It is called EC Market. And using the post title " EC Market auction tracker ", is covered by Descriptive Fair Use, where 'auction tracker' describes my product which tracks auctions.

Anyways, we're past this. If he wants to "track" me "down", he can take more than 0 seconds to look.

To be safe, though, I'd probably change the name to something like, "Jack Wilson's Impotent Threat Generator".

sigh

No, Mr. Wilson's company is the assignee of the word mark "Auction Tracker" for a very narrow field of goods and services:

Word Mark AUCTION TRACKER
Goods and Services IC 009. US 021 023 026 036 038. G & S: computer software for use in the management of fund raising events or tracking guests, volunteers, donors and sponsors, assigning goods numbers and seating assignments, exporting to other programs and generating the necessary reports. FIRST USE: 19920000. FIRST USE IN COMMERCE: 19920000

Webewizard is not using the words "Auction Tracker" as a brand or to signify the source of his webpage log parser, but as a generic term describing what his log parser does, i.e. tracks auctions. I find Mr. Wilson's claims of confusion highly dubious.

Additionally, your example is completely inapposite. Pespi has trademarks specifically for beverages branded Pepsi. Of course you can't go out and make another beverage and brand it Pepsi. You could make Pepsi brand water-well drilling services or Pepsi brand oriental rugs.

I can go out tonight and start making shoes and call them "Auction Tracker" brand shoes and not infringe Mr. Wilson's trademark. Just like Webewizard can use the generic term "auction tracker" for his EQ emulator log parser.

Wait... this "auction tracker" product does not actually contain the words auction tracker in it. The only thing that does is the forum post.

He's referring to the original ec tunnel auction tracker that this is an intended replacement for? So is his beef here that the forum post says auction tracker? Or did he just not make the connection that this is the wrong 'product'?

Edit: Barkingturtle already pointed this out.

This is really great but is there a way to limit this to classic and kunark expansions only? It's pulling up results for Velious (which some people may want to see) but also for expansions beyond that.

For example: searching for chest pieces for Shaman with +wis on it includes Nathsar Breastplate which is labeled as post Velious.

BarackObooma, the item database comes from items listed from project1999's wiki under the Item category. Some items are missing, some items are incorrect, some items don't really exist. http://wiki.project1999.com/You_Mad_Brew

I like the idea of being able to filter by expansion though, perhaps you'll see that in an ec market v 1.5 :)

Why are you posting legal threats on a forum that has absolutely zero affiliation with the program in question?

Please do not use our forums as your legal soapbox, Auction Tracker guy.

This is completely inappropriate, unprofessional, and unwarranted. You don't see us coming to your place of business and harassing your customers, please do not do the same to our players.

Edit: You may also want to read Ele's post above. He might have a bit of experience with IP law.
