You don’t have to name someone to violate their PHI, if the information you disclosed would allow the public to discern who you mean based on the info given. For example, saying the “person that died at my work in the parking lot” pretty much narrows it down to a single person if the public knows where this healthcare worker works, since only 1 person probably died in the parking lot that day

It’s illegal yes, to refuse service based on someone’s race, religion, etc. So all you need to do is sue and maybe get that fat settlement money

For the court to side with the gay couple, they probably had a request for just them side by side on the cake or something. If their request was unreasonable, or would have been seen as unreasonable by the court, they might have lost their lawsuit. For example, if they asked for a cake of them sodomizing each other, with the headline “Christianity is a sham” or something that could be seen as completely obscene and blasphemous to a Christian baker, that baker might have been legally allowed to refuse

Just like if a gay person came in a store and was immediately belligerent, cussing out the other customers and insulting the store owner, I don’t think they would win a discrimination case if the store owner kicked them out and refused to serve them afterwards

I now know a lot more about individual constitutional rights, court case law, and what police are and are not allowed to do

For example, I learned simply remaining silent is not a legal option to avoid incriminating oneself, since it on its own does not do enough to alleviate suspicion of criminal activity. The person must say out loud or mention in some way that they are invoking their 5th amendment right or that they are choosing to remain silent. Also, police are allowed to ask questions, but in many circumstances, people are not under any legal obligation to answer or even to identify themselves to police. This is unless the police can provide articulable evidence the person is committing or has committed a crime

Also, some people are just complete dicks to police on camera on purpose. Like, professionally. They call themselves “first amendment auditors”. They’re not common, but they are out there

You can refuse to provide a service to anyone as a private business owner. You just can’t SAY it’s because of their race, sexuality, religion, etc. But you can still do it for these reasons, if you can provide another reason that a court would find as reasonable. For example, you could say “I’m refusing to bake you a cake because I don’t like your personality”. Of course that might be hard to prove that’s it’s not because the person is gay. It’s all about what you can prove to a court. And courts are all about what is considered reasonable to the average person

If sex-related discrimination still seems like the most reasonable motive, you might still lose in court
