In September 2020, the bill (as H.R. 5602) passed the Democratic-majority House unanimously, but the Republican-majority Senate prevented a vote. Sen. Ron Johnson said the Justice Department had claimed the legislation might "impede" rather than enhance its ability to combat far-right violence. A Justice Department spokesperson alluded to "technical concerns" with the bill but did not elaborate.

The Department of Homeland Security reported in October 2020 that white supremacists posed the top domestic terrorism threat, which FBI director Christopher Wray confirmed in March 2021, noting the bureau had elevated the threat to the same level as ISIS.
