Should the person request it? Maybe, so people know they died to PVP and not in a grp to mobs ETC. That sounds like a legit concern. If a group wipes are they required to LNS and be PVP free naked? That is what I find confusing about the Andis situation and that needs clarification.
OOC has been cleaned up - PVP has been cleaned up from what I've seen, stop bitching and jump on board.

You're screwing over a system that's supposed to help the resistance and new players - yes if someone dies in PVP killing them naked once is punishable.
That being said, you're making this far too complicated - usually the global YT message will clear this up, if you just logged on maybe don't just start nuking nakeds? It isn't rocket science and you're trying to create drama over all the arguments Nihilum uses to farm newbies off the box, and crush weak guilds.
