When a bard has a lute equipped you can loot a corpse of yourself or a mob and if the item is flagged as primary usable it will auto loot to primary even though a lute is equipped. Tested this using a hand drum and didn't encounter the same issue. Once unequipped the item will not allow you to put it in primary again, this issue is strictly with loot auto assigning it to the slot. Have done this with a variety of items.
