There is a entire case in Arizona where they are trying to give 'fetal personhood' to a fetus (embryo or fertilized egg).

To break it down so even Jibartik can understand... they are trying to actually create the policy mandates that "hundreds of civil and criminal provisions be 'interpreted and construed' to 'acknowledge' the rights of fertilized eggs, embryos, and fetuses at any stage of development.

So the Brandy lady, who has probably already delivered her baby and has the good sense not to tweet, would no longer qualify for the infraction protection.
