Game Mechanics: FD/Sneak while Buying and Selling

I'm not sure if this occurred with the patch or not, because I was in friendly territory up until this afternoon. Anyhow, now when I feign death I receive the message, "You cannot use a merchant right now." even if I sneak and am laying behind the merchant.

I can still sneak behind merchants in non-KoS territory to trade, but this isn't possible in places where the surrounding NPC's are hostile. Anyone else having similar problems?

you have to stand up before you can use the merchant.

You need to flop behind the merchant, then stand and hit sneak (and hope sneak works).

If this isn't working then something might be wrong. But you can't shop/bank while FD'd.

You were in fact capable of banking/buying/selling while FD'd as of the last time I attempted it prior to today. Actually I can still bank while FD'd.

I was never able to use a merchant while FD'ed in High Hold Keep as of last week and as of October 2010 - December 2010.

Weird, maybe I was bugged and it was fixed then?
