Game Mechanics: Naggy not banishing

As a level 54 ranger , i was able to cast Call of Flames on Naggy w/o getting banished. Hopefully you guys can figure out what is causing this .

Rumors is all I have on this one, but this is what ive heard :

As long as the person who is tanking holds and keep agro is lvl 52, anyone can attack Naggy and VoX without being banished.

It's almost as if unless you are #1 on the hate list nobody will get banished.

Just rumors tho....
