In short, the settlement heavily favored Daybreak with a permanent shutdown/injunction but imposed no actual cash payment from Takahashi or Taylor at the time of resolution. The $3.5 million is purely a conditional penalty (often described in coverage as a "threat" or "IOU" hanging over them), not money they paid to settle.

The Takahashi party (Kristopher Takahashi and co-defendant Alexander Taylor, operators of the EverQuest emulator "The Heroes' Journey" or THJ) literally paid $0 to Daybreak Game Company LLC to settle the copyright/trademark infringement lawsuit brought against them.

That's a whole lot of speculation in that post. It is not disclosed what the settlement was for - but you'd be a fuckin idiot to expect Daybreak to pay their lawyers a shit ton of money to try this case for months on end, and not get any immediate monetary relief.

Especially when THJ was making $100k a month.
