Doesn't apply if you don't convince a judge to grant a search warrant before you smoke someone in his own apartment
no warrant necessary for smell, only if its not in plain sight.

fact is as usual p99 is out of the loop.

search warrants were executed for marijuana. Texas Supreme court ruled scent of marijuana is exigent and does allow you immediate access to an apartment or unit in the state of Texas.

She has 2 avenues for defense she can go with.
Harris county decriminalized possession on private property aka a residence

hope this planking helps

Just a fancy way of saying it's still illegal.

And now that oil has dominance over america. it may give cannabis a shot at being legal.
Since they were on the side against it previously. But now that oil, cotton, etc businesses are in contorl. They want people high and not thinking straight.

How does this relate to another brother shot dead?
"THE SMELL" "probable cause"

ps. she got him high and killed him.

Quantities are still criminalized and cause for immediate investigation

Hope the full extent of the law and not just an excerpt of some policy helps

This is a tactic used during traffic stops, mainly. I can see how it would apply to a residence too tho'. Yeah, been searched before. It's annoying then they get pissy when nothing is found.

That only works if she was aware that it wasn't her apartment. Her defense was that she thought it was her home. Why would she execute a search warrant for marijuana on her own home?

Exactly. It’s not going to work. Try to convince the jury she walked into the wrong apartment and found some man she thought was burglarizing her place. It also just happened to reek of marijuana out in the hall. Yea ok.

It’s also going to be very telling when the facts come out about who made the noise complaints which prompted management to check it out.

She’s better off sticking to the I walked into the wrong aparentment and shot someone in pitch dark story.

I’m also curious to see if there’s any camera footage of the outside or this dudes place proving if there were lights on.

Maybe. But there is strong indicators she is going with a combination of "wrong apartment" and potential crime in commission (marijuana).

She'll mix both defenses and get a hung jury. There will be no retrial.

Warrants were executed on her behalf AFTER she had already gave her initial statement.

Initial statements, and any statement for that matter, can be added onto and changed for trial at any time.
