CNN's explanation (and I assume Judge Brown's) is the laws were written when the internet was newer, so it was harder to find and download child porn. Now that the internet is bigger and faster, you can download child porn very quickly, so the laws are too harsh because its essentially based on how much content you have, and the laws were written at a time when it took longer and was more difficult to get that content.
