Just because your rights can be violated, doesn't mean you don't have rights.

A cop can forget to read you your Miranda rights (thus violating your rights) and later in court you can be defended and have your case thrown out for it.

If the rights of a group are regularly violated at a higher rate than the rest of the population, it is fair to say the group has less rights in practice. Citing individuals is not a refutation of this.
