The law. The law allows for them.

"While arbitration law permits parties to resolve private disputes through private channels, faith-based arbitrators cannot deal with criminal matters, impose physical punishments, violate people’s rights or overstep the bounds of the authority granted to them by the law and the parties regardless of what their religions may teach."

Yes, it allows for toothless courts that jave no authority whatsoever when it comes to enacting tangible punishment. Thanks for agreeing.

Of course, but the way the current law is, there is no way a Sharia Court could operate at full strength.

They would be able to settle disputes about angry neighbors and that's about it.

The people involved retain all of their constitutional rights.

So the US government basically gently pats a Sharia judge on the head and sweetly says, "Of course you can play courtroom if you want, but if you go too far, we break your fuckin' knees."

Because a full Sharia Court is ultimately unconstitutional.
