This is implying something was done intentionally however the offender himself has explained the situation with open and sincere apologies.

Accidents happen, people shoot others by mishandling firearms, does that mean that person should be put in jail for pre-meditated murder? No.

No, they are put in jail for manslaughter.

Ignorance is not a reasonable excuse. Regardless of whether or not a puller know theres a major fight going on, they are responsible for being cautious about an incoming pull they have when they know for a fact there are people there.
