What that means is- lets say you broke into the store or home of a nice person. The police were called and caught you in the act. Then the owner says Oh- let the poor guy go. The officer says "Sorry, since you didn't complain , I witnessed the crime and will continue to prosecute.

Now also 'hinting' for others to do it falls under a extra charge of Conspiracy. Actually actually conspirators get more prison time then the person committing the crime.
