The only way you could get him prosecuted in some form I imagine is if he stores them on his HDD. But judging by the way he posts them, I'd think not.. who knows.

It is harassment and cyber crime. But this is an emulator so no one cares. If he were doing this to the live forums and server, then he would probably see jail time.

It would depend on the applicable statutes. I don't know what state he is in, what states have laws concerning this kind of thing, whether there are federal laws that are applicable, or anything else like that.
I am pretty sure he wouldn't have to keep these stored on his harddrive in order to get in trouble for distributing them, just like a drug dealer wouldn't have to be caught with crack in his dresser drawer in order to get him in trouble for selling it on the corner. | ||

Oh sure I can completely agree, but I think if he was storing them it's much more possible of a prosecution.. but like you said, who knows what state he is in with certain laws etc etc
