I don't think that makes punk music sound very much alive i'm afraid.

DBG knows the vast majority of people are too law illiterate to understand that as long as you're not profiting off the games IP that you're pretty much in the clear. The fact that EQemulators announced this is pure overkill panic levels of hysteria.

I wanted to ask J-cGP if it was what it does say.

it sayz:

Quote:
The terms don’t literally say “as long as you’re not profiting off the game’s IP you’re in the clear.” What they actually say is that EQEmulator is allowed only for non-commercial, fan-based use, and Daybreak (the rights holder) can shut you down anytime for any reason, even if you are following the non-profit rule.

So in plain English: yes, you’re mostly safe as long as you’re not making or taking any money or value from running an EQEmu server — no donations, ads, perks, subscriptions, or merch. But “in the clear” isn’t guaranteed, because Daybreak still reserves the right to revoke permission at any time.

So the short version is: non-profit = tolerated, but not legally protected.

I wonder if that means THJ can re-launch a server with no donations just to fuck with them and see what they do.

Well DBG knows that the lawsuit they won will spook enough people to not even dare take their bluff of a C&D against a non-profit server utilizing custom content. This is nothing new in the grand scheme of emulation and PC mod projects since the late 90's ever since the 1999 Sony Computer Entertainment, Inc. v. Connectix Corp. lawsuit which was a pivotal moment in emulation history where a scrappy underdog not just took the bluff, but won.

Imagine how incredibly based it would be if the THJ servers go up after the lawsuit with strict no donation policy

You'll die before the investment bank will go bankrupt. The process is the punishment.
