If you think about it it's pretty socialist for the state to enforce some kind of property rights after ones death. Once your dead, you can no longer defend your property...

that's right. the state should step in and claim it for the common good and ensure it isn't seized by people who had nothing to do with it, such as your descendants, to block this capital accumulation vector.

Can we add in capital gains from inheritance? When my grandparents died my mon got close to $100k so not even close to the $11M being tossed around here. So while she paid no death/estate tax she did fork out a massive amount in capital gains.

There is no capital gains on inherited cash/securities, with the exception of inherited IRA or 401k accounts (which haven't been taxed previously when held by the deceased). If your mom inherited $100k in securities or real estate that appreciated to $100k+X (between the time of death and sale), she would only pay capital gains on the $X amount.

That's the last of my free wealth management advice for you nerds.

So you're saying TurboTax fucked up? She inherited a piece of land that's in the middle of nowhere; not worth diddly to any type of developer. However the mineral rights are worth a fair amount. According to TT she needed to send in a big chunk of cash to cover capital gains.

TY for the heads up. I'll tell her to go bug either a CPA or tax attorney.
