The Espionage Act doesn't really care if a document has been deemed classified. It makes it a crime to retain, without authorization, documents related to the national defense that could be used to harm the United States or aid a foreign adversary.

Prosecutors could argue that a document meets that act’s standard regardless of whether Trump had pronounced it unclassified shortly before leaving office.

I dunno why jan 6th is such an issue for either side. Like, I think anyone who actually committed crimes, especially violent crimes on that day should be held accountable. But their punishment should roughly fit the crime. Locking up some confused grandma who wandered in and was dazzled by the spectacle of it all in solitary confinement seems a bit cruel and unusual.

The right sometimes downplays it too much, but that is far outweighed by how hyperbolic the left gets about it. No, our democracy was not even remotely in danger. It was like a handful of doofuses who actually went in, out of tens of thousands who declined to participate. The rowdy ones got booted out of the joint and everything resumed as normal, trump conceded, and there was a completely peaceful transfer of power. Moveeeee onnnnnn.
