You're wrong. The constitution was written to limit what the federal government can do. Anything not specifically called out in the constitution for the federal government, was left to the states or the individual.
And, it was not meant to be a "living" document, despite what the left may think. Any changes to the constitution is to be done through amendments, not through interpretations of those in power at any given time. And, the courts are supposed to uphold the constitution as written, not based on what their political ideology is.
