Drugs aren't really a fair comparison either, because people choose to do drugs. The whole issue with abortion is that you *didn't* choose to get pregnant, it was accidental. The incentive structure is totally different.

Fetal viability (ability to survive outside the womb) occurs 22-24 weeks. You have a much stronger argument when the fetus is able to survive on its own. Up until that point, it is reliant on its mother and the mother's best interests, whatever she deems them to be, come first as far as I'm concerned.

People who take the Texas case as a change in precedent are nitwits on both sides. The viability thing you mention is Casey and still the law, that hasn't changed.
