That I do not understand. If it's ok to host the server and it's fairly obvious that Trilogy box is nothing more than a collector's item - rather than a legitimate way to obtain the LIVE version of EverQuest, then why would P99 giving out precompiled data /discs be a problem?

Apples and oranges.

The server hosting coding is owned by the people running the emu. Sony does not own that code (Sony v. Bleem; Sony lost; 3 times).

Distributing the game that Sony still owns, however ancient? That's a no-no.
