"Provoked" is itself a stupid term. Kyle wasn't provoking anybody, but even if he was, it falls upon the provoked to not resort to violence.

Even if kyle was going "boogey boogey look at me! I have a gun! I am a threat! Please chase me and kill me!" you can't just chase him and kill him if he hasn't fired his weapon at anyone.
