I don't know that we can speculate on what their defense will be. Could they mention P99? Maybe.

Would that be a good defense? Not at all. DBG negotiated an agreement with P99, which an IP holder is totally allowed to do without waiving their rights to enforce the IP against other infringers.

Companies whose products brand names are synonymous with the product regardless of the actual brand, such velcro, band aid and kleenex basically have an obligation to protect their brand.

Trademark and IP are 2 different things, you dont have to protect your IP like you do a trademark iirc. IANAL, but if i remember from business classes correctly.
