His comment is not really racist, more culturist. Although, sad to say, the OP is not far off the mark. After living in the Mid East for over a year now in a culturally diverse city with many different Mid East nationalities represented, you learn certain things.

(Certain entitled) Middle Easterners are raised in a culture where if you want something you have to kick and scream to get it. In the West, usually asking politely is the best way to get assistance or help/service from someone. In the Middle East, you can ask politely for something at the DMV or a shop 500 times... nothing will happen. Turn up the asshole meter, or perhaps even yell, and you are treated like a King. Not just the squeaky well gets the grease... but the loudest, most obnoxious, squeakiest wheel doing the most damage gets the grease. Also, a lot of Mid East countries are very class-oriented (read: caste system in full effect!), so dropping authority/titles is sometimes the best way to cut through the lazy non-helpful BS.

A funny thing, a lot of Middle Easterners don't like to say no... such direct resistance is not really part of their culture. So they ignore, misdirect, or even lie when push comes to shove in an important business decision.

But yeah, OP probably wasn't speaking from experience with Middle Easterners... but then again, calling him a redneck and (jokingly I hope?) hoping BS legal debt on someone is lame. /backstab Aren't you part of some debt-ridden 99% or something? (also, redneck implies white, lots of asians and blacks are racist towards Middle Easterners... again back to the culturist point... you make assumptions galore!)

The OP isn't even capable of driving--and we're supposed to trust his on-scene medical diagnosis?

In any event, it doesn't matter what the other guy gets paid, your rates will probably increase, regardless. When deciding your rate, insurance companies don't get reports informing them how much has been paid-out in prior claims. They just receive notice you've been involved in an accident--either by means of a Motor Vehicle Report or a more generic claims report where not-at-fault accidents and other comprehensive claims are recorded.

So, the advice here should be: grow up, pay attention when you're operating a vehicle, and accept responsibility when you screw up.

any advice would be helpful on what to do.
My mom's car was totalled and has permanent disability from a 5 or so-mph rear-ender. Frankly, you're screwed and probably deserve it. Guy probably isn't lying much. Insurance companies will not total a car unless it's the case. The owner of the car is not the one who decides this. If the damage is more than a certain %age of the value of the vehicle, it's totalled. Period. You should have paid better attention.

hopefully u have a friend or family that is a lawyer, get on the tele with the insurance. most of these jerkoffs go away when they realize that A) youre not going to settle out of court, and B) its going to cost them court fees if/when they lose.
also you need proof that you were rear-ended and pushed into his car.

I appreciate the relevant information and the troll remarks.

I'm not racist nor a redneck, I was just making a demographic remark. I also wasn't high or texting...good troll though I suppose.

It was raining in the city, the guy braked real hard and late to attempt to avoid hitting the car in front of him and I naturally had a delayed response and slammed my brakes. He hit the car in front of him first and then I tapped him afterwards.

I'll let insurance handle it at this point, I gave them all the information they needed so nothing I can do at this point.

You misread his statement. He rear-ended someone, who was pushed into the car in front of it. The FIRST car in line (the second car to be hit) took off (fled the scene, technically even tho this person was hit by the first person who was hit, this person still committed a crime).
