Lvl Range bug or OOR

I was casting on a lvl 1 @ lvl 4 in Nek. Conned threat to me, says he is protected? Is there no lvl 1 pvp, or is he OOR, I thought it was 4 lvls.

level 1s are protected in city zones only. if they make aggressive moves, they should no longer be protected.
